The Infrastructure Investment and Jobs Act (IIJA) (Public Law 117-58, November 15, 2021), known as the Bipartisan Infrastructure Law (BIL), provides $1.2 trillion in funding including $673.8 billion to transportation programs over five years.

The U.S. DOT is authorized at approximately $659.9 billion of those funds. Of the total amount of $673.8 billion, $379.3 billion will go to highways, $116.1 billion will go to transit, $102.5 billion will go to rail, $25.0 billion will go to air, $7.3 billion will go to water, $1.3 billion will go to pipeline, and $42.2 billion will go to other transportation programs.

The BIL includes approximately $379.3 billion in funding for highways over five years, with $361.1 billion of that amount being guaranteed funding, $311.9 billion of which is authorized from the Highway Trust Fund. Of the total funding for highways, the BIL authorizes $362.6 billion to the Federal Highway Administration (FHWA), $5.1 billion to the Federal Motor Carrier Safety Administration (FMCSA), and $8.5 billion to the National Highway Traffic Safety Administration (NHTSA). Of the $362.6 billion authorized for FHWA for highways, the BIL designates $43.3 billion of that amount for bridge investment, replacement, and maintenance (with $40.0 billion of that amount being guaranteed funding).

The BIL authorizes $116.1 billion for transit, of which $106.1 billion is authorized to the Federal Transit Administration (FTA). Of the total of $106.1 billion that is authorized to FTA, $89.8 billion is guaranteed funding, and $69.8 billion of those funds are from the Mass Transit Account of the Highway Trust Fund. In addition to the transit funding authorized to FTA, the BIL also authorizes $10.0 billion to the Environmental Protection Agency (EPA) for the Clean School Bus program for clean and zero emission buses.

The BIL includes $102.2 billion in funding for the Federal Railroad Administration (FRA) over five years, of which $66.0 billion are guaranteed funds. Of the total of $102.2 billion, $41.2 billion are grants to Amtrak. An additional $320 million of funding for rail is made available to the Office of the Secretary of Transportation (OST) for loans and loan guarantees for railroad rehabilitation and improvement.

The BIL includes $25.0 billion in funding for the Federal Aviation Administration (FAA) over five years, all of which is guaranteed funding, split between Facilities and Equipment, Airport Infrastructure Grants, and the Airport Terminal Program.

The Maritime Administration is authorized at $2.3 billion over five years for the Port Infrastructure Development Program, all of which is guaranteed funding. The BIL also authorizes $1.5 billion to the Army Corps of Engineers for Rehabilitation, Construction, and Related Activities for Rivers and Harbors.

The Pipeline and Hazardous Materials Safety Administration (PHMSA) is authorized at $1.3 billion of funding over five years, of which $1.0 billion is guaranteed appropriations for the Natural Gas Distribution Infrastructure Safety and Modernization Grant Program.

The BIL authorizes the Office of the Secretary of Transportation at approximately $42.2 billion over five years, with much of that going to large grant programs such as the National Infrastructure Project Assistance program (sometimes referred to as the ‘Megaprojects’ program) which receives $15.0 billion and the Rebuilding America’s Infrastructure with Sustainability and Equity (RAISE) Grant Program which receives $15.0 billion. In addition, the Bureau of Transportation Statistics is authorized at $182.5 million.
